MAXFUN  GENERAL WAIVER

NOTICE TO USER: PLEASE READ CAREFULLY BEFORE PARTICIPATING OR MAKING A PURCHASE

By entering the Maxfun premises and/or purchasing any tickets, you confirm that you have read, understood, and agreed to the terms and conditions below. If you are signing on behalf of a minor or person under your care, you agree that you are acting as their responsible guardian.

1. Definitions

• Service Provider: Refers to Maxfun Entertainment(Pty) Ltd 2025/115850/07, a company registered in South Africa, operating in Johannesburg, including its directors, employees, agents, successors and assigns.
• You / The Participant: Refers to any individual entering the premises or participating in the recreational activities, including minors under the care of a parent, guardian, or responsible adult.
• Recreational Activities: Includes but is not limited to trampolining, climbing structures, obstacle courses, zip lines, soft play, slides, and all other activities offered by Maxfun.

2. Risk Warning

By entering the Maxfun premises or participating in its activities, you acknowledge and accept that:

• The recreational activities involve inherent risks, including physical exertion, height, impact, and motion, which may result in injuries such as:
  • Sprains, strains, bruises, broken bones, head injuries;
  • Concussion, spinal injuries, or in extreme cases, serious injury or death.
• These risks exist even when safety instructions and equipment are followed.
• Additional risks may apply to individuals with pre-existing medical conditions, including pregnancy. It is your responsibility to consult a medical professional if in doubt.
• You voluntarily accept these risks and agree that participation is entirely at your own risk.
• Maxfun may, in its sole discretion, deny access to activities to individuals it deems unfit for participation (e.g., under the influence, wearing a cast, visibly unwell).

3. Limitation of Liability (CPA Notice)

Under the Consumer Protection Act 68 of 2008 (CPA), consumers have certain rights. However, by accepting these conditions, you acknowledge and agree:

• That Maxfun, its owners, employees, and agents shall not be held liable for any injury, loss, damage or death arising from participation in recreational activities, except in cases of gross negligence.
• That Maxfun shall not be liable for any indirect or consequential losses, including medical costs, loss of income, or emotional distress, arising from use of its facilities.
• That this waiver applies to each visit, unless and until revoked in writing or replaced with a new agreement.

4. Conditions of Entry

• All participants must read and follow safety signs and instructions displayed throughout the premises.
• Grip socks are mandatory and must be worn at all times on trampolines and inflatable surfaces.
• Persons under the influence of alcohol or drugs will not be allowed to participate.
• Children aged 16 and under must be accompanied by a responsible adult at all times.
• The maximum weight limit per trampoline is 130kg, in accordance with international safety standards.
• All instructions by Maxfun staff must be followed. Failure to comply may result in removal from the premises without refund.
• All tickets remain the property of Maxfun and are non-refundable, non-transferable, and only valid for the specified date.

5. Photography & Security

• CCTV monitoring is in operation throughout the premises for safety and security purposes.
• By participating in Maxfun activities, you consent to being photographed or filmed for promotional purposes. Should you wish to opt out, please notify us in writing in advance.

6. Declaration & Indemnity

By signing this agreement or purchasing a ticket:

• You declare that all information provided is accurate and that you are medically fit to participate.
• You indemnify and hold harmless Maxfun (Pty) Ltd, its employees, agents, directors, and successors against any claim arising from:
  • Injury or death;
  • Loss or damage to personal property;
  • Participation by a minor or a person in your care.
• If you are signing on behalf of a minor (under 18) or someone under your care, you do so as their legal guardian or responsible adult and accept full responsibility for their compliance with these terms.

7. Governing Law

This agreement is governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Johannesburg, Gauteng.

By entering Maxfun or participating in its activities, you agree to these terms in full.
